Please read these Terms of Use carefully before accessing or using the Aijency platform. By completing registration and ticking the acceptance checkbox, you confirm that you have read, understood, and agree to be bound by these Terms.
These Terms of Use (“Terms”) govern your access to and use of the Aijency platform, including the AI agent widget, admin portal, API integrations, and all related services (collectively, the “Service”), provided by Aijency (“we”, “us”, or “our”).
By registering for an account, ticking the acceptance checkbox during onboarding, installing the Aijency widget, or otherwise using the Service, you agree to these Terms. If you are using the Service on behalf of a business, you represent that you have authority to bind that business to these Terms. Your acceptance is recorded electronically with a timestamp and associated with your verified email address.

To use the Service as a Tenant (business customer), you must create an account and provide accurate registration information. You are responsible for maintaining the confidentiality of your account credentials, all activity that occurs under your account, and notifying us promptly of any unauthorised use at info@aijency.ai.
You may use the Service only for lawful business purposes. You agree not to:
We reserve the right to suspend or terminate access immediately and without notice if we reasonably believe a violation of this section has occurred.
The Service integrates with third-party platforms including Zoom, Google Meet, Microsoft Outlook, Microsoft Teams, HubSpot, and Google. By connecting these integrations, you authorise Aijency to access and act on your accounts within the OAuth scopes you grant. We are not responsible for the availability or conduct of third-party platforms.
Our collection and use of personal information is governed by our Privacy Policy. As a Tenant, you act as the data controller for personal information collected via your deployed widget and are responsible for providing appropriate privacy notices to visitors and obtaining any consents required under applicable law, including the Australian Privacy Act 1988 and, where applicable, the EU General Data Protection Regulation (GDPR).
Aijency retains all rights in and to the Service. You retain ownership of your data and grant us a limited licence to process it as necessary to provide the Service. Content you upload to the Knowledge Base remains your property; you grant us a limited licence to process and store it solely to provide the Service.
The Service is provided on an “as is” and “as available” basis. We may perform maintenance or modifications that temporarily affect availability, with reasonable notice where practicable.
To the maximum extent permitted by law, Aijency will not be liable for any indirect, incidental, special, or consequential damages, including but not limited to loss of revenue, loss of data, loss of business opportunity, or reputational harm, arising out of or in connection with your use of the Service. Our total aggregate liability to you will not exceed the total fees paid by you in the 12 months immediately preceding the event giving rise to the claim.
Nothing in these Terms limits liability for fraud, wilful misconduct, or any liability that cannot be excluded by law.
You may terminate your account at any time by contacting info@aijency.ai. Termination takes effect at the end of the current billing period unless you request immediate termination, in which case no refund will be issued for the remaining period. We may suspend or terminate your access immediately if you breach these Terms, fail to pay amounts due, or if we are required to do so by law.
These Terms are governed by the laws of New South Wales, Australia. Any disputes arising under these Terms will be subject to the exclusive jurisdiction of the courts of New South Wales, Australia, except where mandatory consumer protection laws in your jurisdiction provide otherwise.
We will notify active Tenants of material changes by email at least 14 days before they take effect. Your continued use of the Service after that date constitutes acceptance of the updated Terms. If you do not agree to the updated Terms, you must cease using the Service and contact us to close your account before the effective date.

This section governs all financial terms relating to your subscription to the Service. By completing the onboarding checkout, you agree to these billing terms in addition to all other provisions of these Terms.
The Service is offered on a monthly subscription basis across three tiers: Starter, Growth, and Pro. Each plan includes a defined monthly conversation allowance and access to features as described on our pricing page at the time of your subscription. Plan features and conversation limits are set out in your account dashboard.
Subscriptions are billed monthly in advance. Your billing cycle commences on the date your payment is first processed and renews on the same calendar date each month (your billing anniversary). Subscriptions renew automatically unless cancelled in accordance with Section 14.5. You authorise Aijency and its payment processor (Stripe) to charge your nominated payment method on each renewal date without further authorisation.
Each subscription plan includes a monthly conversation allowance that resets on your billing anniversary each month. Conversations commenced but not completed before the reset date count toward the current month’s allowance.
Overage charges are calculated at the end of each billing period and added to your next monthly invoice. You will receive an email notification when you reach 50%, 75%, 90%, and 100% of your monthly allowance.
All prices are quoted in Australian Dollars (AUD) and are exclusive of Goods and Services Tax (GST) where applicable. GST will be added to invoices issued to Australian customers in accordance with the A New Tax System (Goods and Services Tax) Act 1999. Customers outside Australia are responsible for any applicable taxes, duties, or levies imposed by their local jurisdiction.
You may cancel your subscription at any time via the Billing page in your dashboard. Cancellation takes effect at the end of your current billing period. You will retain access to the Service until that date. No refund or pro-rata credit will be issued for the unused portion of a billing period following cancellation, except where required by applicable Australian Consumer Law.

Refund requests must be submitted to info@aijency.ai within 14 days of the charge in question.
If a payment fails, we will notify you by email and retry the charge up to three times over seven days. If payment remains unsuccessful after three attempts, your account will be suspended. Suspended accounts retain their data for 30 days, during which time you may reactivate by updating your payment method. After 30 days, we reserve the right to permanently delete the account and all associated data. Reactivation of a suspended account requires payment of all outstanding amounts.
You may upgrade or downgrade your plan at any time via the Billing page in your dashboard. Upgrades take effect immediately. Downgrades take effect at the start of the next billing period. No pro-rata adjustment is made for mid-cycle upgrades; the difference in plan price will be reflected in your next invoice.
All payments are processed by Stripe, Inc. Aijency does not store your payment card details. By subscribing, you agree to Stripe’s terms of service available at stripe.com/au/legal. Aijency is not liable for any errors, failures, or unauthorised transactions arising from Stripe’s payment processing infrastructure.
Promotional codes and discount offers are subject to their stated terms and expiry dates. Unless otherwise stated, promotional pricing applies to the first billing period only, after which the standard plan price applies. Promotional codes cannot be applied retrospectively, combined with other offers, or exchanged for cash.
If you believe a charge has been made in error, you must notify us at info@aijency.ai within 30 days of the charge. We will investigate and respond within 10 business days. Initiating a payment dispute or chargeback with your bank or card issuer without first contacting us may result in immediate suspension of your account pending resolution.
